Terms of service
Terms of Service
These terms govern your use of the AirGearPro website and any purchase you make through it. They are written for UK consumers and apply alongside your statutory rights under UK consumer law, which are not affected by these terms.
Please read these terms carefully before you place an order. By placing an order, you agree to be bound by them.
Effective date: 28 May 2026.
1. About us
This website is operated by AirGearPro. Full company information is set out in our Legal Notice. The customer service contact for any matter relating to these terms or your order is support@airgearpro.com.
2. Using our website
You may use our website for lawful personal use only. You must not:
• Use the site in a way that could damage, disable, overburden, or impair it, or interfere with another user’s use of it.
• Attempt to gain unauthorised access to any part of the site, our servers, or any connected systems.
• Use the site to send unsolicited communications, "spam", or harmful content.
• Reproduce, copy, sell, or commercially exploit any part of the site or its content without our written permission.
We reserve the right to suspend or close any account or block any visitor who breaches these terms or who we reasonably believe is using the site improperly.
3. Account registration
You can browse and buy from our site as a guest or by creating an account. If you create an account, you must provide accurate information and keep your password confidential. You are responsible for activity that takes place under your account. Tell us promptly if you suspect any unauthorised use.
4. Placing an order and contract formation
When you place an order through our site, you make an offer to buy the goods at the price displayed. We will send you an order acknowledgement by email confirming we have received your order. This acknowledgement is not acceptance of your offer.
A contract between you and us is formed only when we send you a dispatch confirmation email confirming that the goods have been dispatched. Up to that point, we may decline your order for any reason, including:
• The goods are out of stock.
• A pricing or product description error.
• We are unable to verify your payment or delivery details.
• We suspect fraud or breach of these terms.
If we cannot accept your order, we will tell you by email and refund any payment you have made.
5. Price, payment, and VAT
Prices on our website are in pounds sterling (GBP) and include UK VAT at the prevailing rate. Delivery charges, where applicable, are shown at checkout before you place your order.
We accept Shopify Payments (card payments processed via Stripe) and PayPal at checkout. Payment is taken at the time you place your order. We use secure third-party payment processors — we do not store your full card details on our systems.
We make every effort to ensure prices are accurate. If we discover an error in the price of goods you have ordered, we will tell you and give you the option of continuing the order at the correct price or cancelling and receiving a full refund.
6. Shipping and delivery
Delivery options, costs, and estimated timeframes are shown at checkout. Estimated delivery dates are estimates only — we will not be liable for short delays beyond our control.
Risk in the goods passes to you when we deliver them to the address you specified (or to a person identified by you, such as a neighbour). Title in the goods passes to you when we have received payment in full.
If delivery is delayed by events outside our control (Section 12), we will contact you and either extend the delivery period or offer you the option to cancel for a full refund.
Under the Consumer Contracts Regulations 2013, if we fail to deliver within 30 days of order confirmation (or by an essential delivery date you specified), you have the right to cancel and receive a full refund — see our Refund Policy for details.
7. Cancellation, returns, and refunds
Your statutory and contractual rights to cancel, return, and obtain a refund are set out in our Refund Policy, which forms part of these terms. The Refund Policy includes:
• Your 14-day right to cancel under the CCRs 2013.
• Your 30-day short-term right to reject faulty goods under the CRA 2015.
• Our extended 30-day goodwill returns window.
• Excluded categories (used PPE, opened filter cartridges, etc.).
• Refund timing, method, and shipping costs.
Read the Refund Policy on our website.
8. Faulty goods
If goods you receive are faulty, not as described, or not fit for purpose, you have rights under the Consumer Rights Act 2015. These rights are set out in detail in our Refund Policy (Section 6) and include the short-term right to reject, the right to repair or replacement, and the final right to reject. Nothing in these terms limits those rights.
9. Product information and intended use
Our products are personal protective equipment (PPE), respiratory filtration products, safety footwear, and related accessories. They are designed and certified to meet specific safety standards (such as EN 149 for respirators, EN ISO 20345 for safety footwear, EN 166 for eye protection).
Each product page shows the applicable certifications, intended use cases, and key limitations. Before using any product, you must:
• Read the product page, packaging, and any included instructions.
• Confirm the product’s certifications match the protection level required for your intended task.
• Check the product for fit and seal before use, following the manufacturer’s instructions.
• Replace consumable items (filter cartridges, particle filters) at the intervals stated on the product page or packaging.
We provide product information in good faith based on supplier specifications, independent test reports, and applicable certifications. We do not provide personalised advice on selecting PPE for specific workplaces or tasks. If your use case is regulated (for example, asbestos work, COSHH-controlled substances, or specific industrial environments), you should consult a qualified safety adviser to confirm the right product for the job. The HSE provides guidance on selecting respiratory protective equipment at hse.gov.uk.
Product images on our site are illustrative. Actual colour, packaging, and accessories may vary slightly. Where small variations occur, they will not affect the product’s certification or fitness for purpose.
10. Intellectual property
All content on our website — including text, images, logos, designs, video, product photography, brand names, and the look and feel of the site — is owned by or licensed to AirGearPro. You may not copy, reproduce, distribute, or commercially exploit any content without our prior written permission.
You retain ownership of any content you submit to us (for example, reviews or photographs). By submitting content to our site, you grant us a worldwide, royalty-free, non-exclusive licence to use, display, and reproduce that content in connection with operating and promoting AirGearPro.
11. Our liability to you
Nothing in these terms limits or excludes our liability for:
• Death or personal injury caused by our negligence.
• Fraud or fraudulent misrepresentation.
• Any liability that cannot be limited or excluded under applicable law (including liability under the Consumer Rights Act 2015 or the Consumer Protection Act 1987).
Subject to the above:
• We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our negligence. Loss or damage is foreseeable if it is an obvious consequence of our breach, or if it was contemplated by both of us at the time you placed your order.
• We are not responsible for any loss or damage that is not foreseeable.
• Where we supply goods for domestic and private use, we will not be liable for any loss of profit, loss of business, business interruption, or loss of business opportunity. If you intend to use the goods in connection with a trade, business, craft, or profession, our liability to you is limited to the price of the goods.
These limitations are in addition to your statutory rights under the Consumer Rights Act 2015, which are not affected by these terms.
12. PPE — important safety note
Personal protective equipment is your last line of defence. It does not eliminate the underlying hazard. Where reasonably practicable, the hazard should be controlled at source (substitution, ventilation, enclosure) before relying on PPE. We expect users to follow the hierarchy of controls set out in the Health and Safety at Work etc. Act 1974 and associated regulations. Use of our products outside the certified use case, or beyond their service life, may result in inadequate protection — this is outside our control.
13. Events outside our control
We are not responsible for delays or failures to perform our obligations that are caused by events outside our reasonable control — including but not limited to severe weather, industrial disputes, carrier failures, government action, fire, flood, power failures, cyber-attacks, and disease outbreaks. If such an event affects your order, we will contact you as soon as possible and either extend the delivery period or, if the delay is significant, offer you the option to cancel for a full refund.
14. Termination
You can stop using our site at any time. You can close your account by contacting support@airgearpro.com or using the account settings on our site.
We can suspend or close your account if you breach these terms, if we suspect fraud, or for any other reasonable business reason. We will tell you and explain why where lawful to do so. Termination does not affect rights and obligations that arose before termination — including delivery of any pending orders and your right to a refund for faulty goods.
15. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the version in force when you placed your order. We will post the current version on our site with the "Effective date" updated.
16. Governing law and jurisdiction
These terms and your purchase are governed by the laws of England and Wales. As a consumer, you can bring legal proceedings in the English courts, or in the courts of the part of the UK where you live (Scotland or Northern Ireland). We can bring proceedings against you in the courts of the part of the UK where you live.
